Aquaculture (Miscellaneous) Amendment Regulations 2023

The Aquaculture (Miscellaneous) Amendment Regulations 2016 (the Amendment Regulations) amend the Aquaculture Regulations 2016 (the Aquaculture Regulations) and came into operation on 9 December 2023.

About the Amendment Regulations

The Amendment Regulations support the implementation of the Amendment Act for aquaculture related tourism developments. In addition, the Amendment Regulations also contain minor miscellaneous administrative changes applicable to aquaculture farming which will not require physical changes to current aquaculture practices.

The amendments will provide a positive impact for both tourism developments and aquaculture as they are not extensive, improve administrative arrangements for efficient and effective regulation and mitigate risks from their construction and ongoing operation to the environment, public safety and to both industries. This includes social licence to operate and introduction and spread of disease of aquatic organisms which they rely on.

This will in turn provide confidence for proponents of both tourism developments and aquaculture to invest and grow this emerging agritourism industry and important South Australian primary industry, respectively, primarily in regional areas of the State where it will be and is currently based.

The regulations applicable to aquaculture related tourism development are consistent with the intent of the Amendment Act in that they are aligned with relevant provisions already in place for aquaculture to the extent that it is reasonable to do so.

PIRSA undertook targeted consultation to inform the Amendment Regulations through an inter-government agency working group consisting of representatives from:

  • Department for Environment and Water
  • Environment Protection Authority
  • South Australian Tourism Commission
  • Department for Infrastructure and Transport
  • Department for Trade and Investment.

Targeted consultation also occurred with representatives from aquaculture sectors and operators of the two current oyster aquaculture tourism developments:

  • Australian Southern Bluefin Tuna Industry Association
  • South Australian Oyster Growers Association
  • Clean Seas Seafood Limited
  • South Australian Mussel Growers Association
  • Yumbah Aquaculture Ltd
  • Australian Sustainable Seaweed Alliance
  • SA Shellfish Hatchery Association
  • SA Premium Oyster Farm Tours in Smoky Bay
  • Oyster Farm Tours Coffin Bay Saltwater Pavilion

These stakeholders were supportive of the proposed amendments.
