Legislation is in place to provide for:
The Phylloxera and Grape Industry Act 1995 (external site) provides for the functions and powers of the Phylloxera and Grape Industry Board of South Australia (external site). The board is funded by the state's grape growers and carries out important projects in the areas of phylloxera prevention, early detection, biosecurity and education.
The Wine Grapes Industry Act 1991 (external site) relates to the marketing of wine grapes. Under the Act, terms and conditions of payment by processors to producers have been fixed by Order of the Minister.
The Primary Industry Funding Schemes Act 1998 (external site) makes provision for schemes establishing funds through a levy system to generate resources for industry development activities.
Under the Act the government establishes a ‘fund’ that is made up of contributions collected from the members of a primary industry sector. The contributions are collected by industry members and then paid out from the fund in the form of a grant to a body representing the contributors. The funds may be spent on activities that are of benefit to the industry sector, such as research, market and production development and promotion. Government’s role is to implement a cost efficient collection system at minimum cost and ensure payments out of the fund are properly accounted for.
A rolling 5-year management plan needs to be prepared for each fund along with an annual operating plan.
A primary industry sector intending to establish a fund under the Act needs to approach government with a request to establish a fund. It is the responsibility of the industry sector to demonstrate that its members support the proposal for a fund.

Each fund must be supported by the industry. Although the Minister is responsible, each industry must lead the process of developing a proposal for a Fund, and then arranging for delivery of services to the industry.
Ministerial Responsibilities
The Minister for Agriculture, Food and Fisheries also prepares an annual report incorporating the audited financial statement for each Fund and tables these reports in both Houses of the South Australian Parliament.
