Background to the amendment process

The Parliamentary debate

The Mining (Miscellaneous) Amendment Bill 2009 was originally tabled in Parliament on 3 December 2009.

Once Parliament resumed after the 2010 election, the Mining (Miscellaneous) Amendment Bill 2010 (the Bill) was re-introduced into the Legislative Council on 11 May 2010. The Bill was debated on 20 and 22 July 2010 and was passed in the Legislative Council on 14 September 2010.

The Bill (with further amendments) was debated and passed in the House of Assembly on 27 and 28 October 2010.

The Bill (with further amendments) was debated and passed in the Legislative Council on 9 November 2010.

Policy objectives

It is the State Government’s policy to provide sustainable development legislation that embodies triple-bottom-line principles.

In line with this, a review of the Mining Act 1971 (the Act) and the Mining Regulations 1998 (the Regulations) was undertaken by PIRSA (now DMITRE).

A consultation paper on the proposed short term amendments to the Act and Regulations was released by the Minister for Mineral Resources Development and comments were invited from relevant stakeholders.

After consideration of the comments received from the release of the consultation paper, Cabinet gave approval for the drafting of an Amendment Bill.

The Draft Mining (Miscellaneous) Amendment Bill 2009 (.pdf 126.2kb) was released for public consultation in July 2009. More than 40 submissions were received from clients and stakeholders, providing valuable feedback on the proposed changes.

These submissions were considered and a draft Bill was revised and released for consultation on 4 November 2009.

The Draft Bill for comment took into consideration the three State Government key policy objectives of:

  • Red Tape Reduction
  • Greater Transparency
  • Effective Regulation

and issues raised by stakeholders in their submissions on the previous consultation paper.

Those parties who made a submission during the July 2009 public consultation were provided with further information on the November draft Bill.

Draft updated forms under the Mining Act 1971

As part of the amendment process, all forms under the Act will be updated on 01 July 2011. From that date, forms in the old format cannot be accepted.

Drafts of some of the new forms are available for your information below -

Form 22 - Notice of use of declared equipment

Form 23 - Waiver of exemption

Further forms will be added in future.
