The Fisheries Management Act 2007 provides options for persons other than the licence holder to register a third party interest in a fishing licence.
Section 65 of the Act establishes a public register of authorities that are issued under the Act, including commercial fishing licences.
Pursuant to sections 38 and 65 of the Act a licence holder may, upon payment of the prescribed fee, put a notation on that register which identifies another person or entity who has an interest in the licence (“the interest holder”).
It is possible for more than one party to be a registered interest holder. The interest need not be a security interest, but could include any type of interest in the licence.
The Director must not consent to a transfer of the licence without the consent of any registered interest holder. If there is more than one interest holder, consent is required from each party.
In addition, the Act requires that an interest holder be notified of any prosecution proceedings under the Act that are commenced with respect to the licence. Licences are liable to suspension or cancellation for breaches of the Act.
Consent of an interest holder is also required before the Director can accept the surrender of a licence in accordance with section 61 of the Act.
Consent of a third party interest holder is not required in relation to the transfer of a registered device (for example, a rock lobster pot entitlement) and is not required if the licence holder chooses to relinquish a registered device and not re-register the device for the following year.
If a person who claims an interest in a licence seeks further protection of their interest relating to matters such as quota entitlements or other entitlements endorsed on a licence, they should make private arrangements with the licensee.
If a person who is registered as an interest holder requests that their interest be removed from the register, then the Director will give effect to this request.
Information about licences is available on the public register established by section 65 of the Act.
Other information concerning a licence that is not on the public register is subject to confidentiality provisions set out in section 66A of the Act, but can be released with written consent of the licence holder.
Disclaimer The above information is a brief overview of aspects of the Act with respect to security interests over licences, and is not intended to be exhaustive or constitute legal advice.

A Rock Lobster Industry Fund has been set up by the Primary Industry Funding Schemes (Rock Lobster Fishing Industry Funding Schemes Act 1998. It has been set up to fund an industry organisation to implement and administer a strategic plan for the fishery.
The South Australian Rock Lobster Advisory Council (SARLAC) is the recognised organisation that will be supported by the funding scheme. SARLAC has recently conducted extensive industry consultation in relation to a strategic plan for the industry, through port meetings and written communication.
The levy for each licence holder under the funding scheme is $1,200 for 2009/10. Licence holders have the option of seeking a refund of their Rock Lobster Fishing Industry Fund levy. Once the full amount has been paid, licence holders may apply for a refund of their contributions to the fund using this form. The $1,200 can not be paid in two $600.00 installments.
A request for refund of contributions made during the 2009/10 financial year must be submitted before 30 June 2010. Licence holders who claim and receive a refund cannot receive direct benefits or services funded by payments from the Fund.
